Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Azawire Payments Pty Ltd ("Tirra," "we," "us," or "our") governing your access to and use of the Tirra platform, including our website, mobile applications, and all related services (collectively, the "Services").

By creating a Tirra account or using our Services, you agree to be bound by these Terms and our Data Policy. If you do not agree to these Terms, you must not access or use our Services.

Eligibility

To use Tirra Services, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Be legally capable of entering into binding contracts
  • Not be located in a jurisdiction where Tirra Services are prohibited
  • Not be listed on any sanctions lists or trade embargoes
  • Complete our identity verification process
  • Provide accurate and complete information during registration

We reserve the right to refuse service to anyone for any lawful reason, including but not limited to failure to complete identity verification or violation of these Terms.

Account Registration and Security

Account Creation

When you create a Tirra account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate and complete
  • Maintain one account per person (no duplicate accounts)
  • Not create an account on behalf of another person without authorization
  • Complete identity verification when requested

Account Security

You are responsible for:

  • Maintaining the security and confidentiality of your login credentials
  • All activity that occurs under your account
  • Enabling multi-factor authentication for enhanced security
  • Immediately notifying us of any unauthorized use of your account
  • Not sharing your account access with others

We are not liable for any losses resulting from unauthorized use of your account if you fail to maintain adequate security measures.

Services Provided

Financial Services

Tirra provides the following financial services:

  • Digital wallet: Store, send, and receive fiat currencies and cryptocurrencies
  • Money transfers: Send money globally to other Tirra users and external accounts
  • Currency exchange: Exchange between supported fiat and cryptocurrencies
  • Payment cards: Physical and virtual debit cards linked to your balance
  • Crypto services: Buy, sell, and hold supported cryptocurrencies

Service Availability

We strive to provide continuous service availability, but:

  • Services may be temporarily unavailable due to maintenance, updates, or technical issues
  • We may modify, suspend, or discontinue any aspect of our Services at any time
  • Service availability may vary by jurisdiction
  • We will provide notice of planned maintenance when possible

Payment Services

Payment Methods

Tirra supports various payment methods, including:

  • Credit and debit cards
  • Bank transfers
  • Cryptocurrency deposits

Payment Processing

We process payments through secure and reliable payment gateways. Payment processing times may vary based on the payment method and network conditions.

Fees and Charges

You agree to pay all applicable fees for using Tirra Services, including:

  • Transaction fees: Charged for certain types of transactions and transfers
  • Currency conversion fees: Applied when exchanging currencies
  • Card fees: Annual or monthly fees for physical and virtual cards
  • ATM withdrawal fees: Charged for cash withdrawals beyond free allowances
  • Network fees: Cryptocurrency network fees passed through at cost

Current fee schedules are available in your account settings and on our website. We reserve the right to modify fees with 30 days' notice. Continued use of our Services after fee changes constitutes acceptance.

Cryptocurrency Terms

Important Cryptocurrency Disclaimers

  • Cryptocurrency values are highly volatile and can result in significant losses
  • Past performance does not guarantee future results
  • Cryptocurrency transactions are irreversible once confirmed
  • You are responsible for verifying wallet addresses before sending transactions
  • Lost private keys or recovery phrases cannot be recovered
  • Network congestion may delay transactions and increase fees
  • Forks, upgrades, or protocol changes may affect your holdings
  • We do not provide investment, tax, or legal advice

Supported Cryptocurrencies

We may add or remove support for cryptocurrencies at our discretion. If we discontinue support for a cryptocurrency:

  • We will provide at least 30 days' notice
  • You will have the opportunity to withdraw or convert your holdings
  • After the deadline, we may convert holdings to a supported currency at our discretion

Acceptable Use

You agree not to use Tirra Services for any unlawful or prohibited purposes, including:

  • Violating any laws, regulations, or third-party rights
  • Engaging in fraud, money laundering, or terrorist financing
  • Purchasing illegal goods or services
  • Circumventing security measures or exploiting vulnerabilities
  • Using automated tools to access our Services without permission
  • Attempting to gain unauthorized access to other users' accounts
  • Transmitting viruses, malware, or harmful code
  • Manipulating or interfering with our Services
  • Impersonating others or providing false information
  • Harassing, abusing, or threatening other users or our staff

Violation of these terms may result in immediate account suspension or termination and reporting to law enforcement authorities.

Account Termination

Termination by You

You may close your account at any time by:

  • Withdrawing all funds from your account
  • Contacting customer support to request closure
  • Completing any required verification or documentation

Termination by Tirra

We may suspend or terminate your account immediately if:

  • You violate these Terms or our policies
  • We suspect fraudulent, illegal, or unauthorized activity
  • Required by law or regulatory authorities
  • You provide false or misleading information
  • Your account shows signs of being compromised
  • You fail to complete required verification

Upon termination, you must withdraw all funds within 30 days. After this period, we may charge administrative fees for maintaining dormant accounts.

Intellectual Property

The Services and all content, features, and functionality are owned by Tirra and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, modify, distribute, or create derivative works based on the Services without our prior written consent.

Disclaimers and Warranties

TIRRA SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that services will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy or reliability of information obtained through our services
  • Warranties that defects will be corrected

Some jurisdictions do not allow disclaimers of implied warranties, so some of the above disclaimers may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Tirra, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use or misuse of our Services
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Any unauthorized use of your account
  • Your negligence or willful misconduct

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law principles.

Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending an email to your registered email address
  • Displaying a notification in our app

Changes become effective 30 days after notification. Your continued use of Tirra Services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using our Services and close your account.
